Australia’s judicial integrity under fire after judge in COVID vaccine case is accused of failing to disclose links to Pfizer
A judge allegedly failed to disclose her links to Pfizer in a case that would have scuttled its COVID vaccines in Australia – raising serious questions about our justice system, writes Rocco Loiacono.
Drug giant Pfizer is facing lawsuits in several countries over allegations of false claims about the effectiveness of its COVID-19 vaccine and concealing its risks.
In a lawsuit filed last week against the company by the Attorney-General for the American state of Kansas, it is alleged that Pfizer concealed evidence that the shot was linked to pregnancy complications, including miscarriage, as well as myocarditis and pericarditis (these last two conditions are now recognised adverse reactions by the US Food and Drug Administration).
The lawsuit also alleges that Pfizer misled the public by stating that the jab would prevent not only illness but transmission.
In fact, Pfizer executive Janine Small admitted to an EU Parliamentary inquiry in October 2022 that Pfizer never tested the COVID jab in relation to preventing transmission.
When the FDA approved the Pfizer vaccine for use in December 2020, it admitted there was no “evidence that the vaccine prevents transmission of SARS-CoV-2 from person to person”.
In November last year, Texas sued Pfizer for unlawfully misrepresenting the effectiveness of the company’s COVID-19 vaccine and attempting to censor public discussion of the product.
This follows on from the FDA’s unsuccessful attempts to suppress Pfizer’s clinical trial data for 75 years.
Moreover, two weeks ago, a report was published in the reputable BMJ Public Health on a new study, finding that COVID vaccines could be partly to blame for a rise in unprecedented excess deaths in the US and other Western countries in the three years since the pandemic.
The report finds that risk factors were substantially present in clinical trials of the vaccines.
As I’ve previously said on SkyNews.com.au in this column, the Western Australian Government last July published data that showed the number of adverse events reported for COVID-19 vaccines was about 24 times the rate of other established vaccines, particularly in the 18-24 and 25-29 age groups – those least as risk from COVID.
Considering these developments, an action was brought against Pfizer in the Federal Court of Australia last March.
Interestingly though, this case has resulted in an official complaint being made against the judge hearing the matter on account of misconduct.
As recounted in a detailed article by eminent law Professors Augusto Zimmermann and Gabriël Moens, in ‘Re Dr Julian Fidge v Pfizer Australia Pty Ltd & Anor’, injunctions were sought in the Federal Court against Pfizer and Moderna on the basis that they failed to apply for necessary licences to deal with Genetically Modified Organisms (GMOs) in Australia under the Commonwealth Gene Technology Act 2000 (GT Act).
Dr Fidge sought to present evidence showing the mRNA vaccines produced by Pfizer and Moderna objectively satisfy the legal definitions of GMOs, pursuant to section 10 of the Act.
If this were the case, the court then had to consider the question whether Pfizer and Moderna had knowingly breached the GT Act.
If the court so found, then Pfizer and Moderna would be prevented from further using their mRNA COVID vaccines in Australia.
The judge hearing the matter, Helen Rofe, found in favour of Pfizer and Moderna, dismissing Dr Fidge’s case on the grounds that it had no prospects of success since he is not an “aggrieved person” for the purposes of section 147 of the GT Act.
This is where the matter gets intriguing.
To avoid any reasonable apprehension of bias, judges are required to consider whether having acted for one of the parties appearing before them in the past ought to be disclosed.
However, the law firm representing Dr Fidge alleges that at no stage either prior to or during the hearing of the case, did Justice Rofe disclose that, while practising as a barrister, she seemingly both directly and indirectly represented Pfizer in at least five separate and long-running matters.
As Zimmermann and Moens affirm, the rules regarding judicial bias require that, when a judge has had prior dealings with one or more parties to proceedings, he or she is obliged to consider disclosing all details and inviting the parties to make submissions on whether that judge should recuse him or herself from the proceedings.
While her Honour’s work as counsel for Pfizer is a matter of public record, it is alleged that no such disclosure was made to Dr Fidge’s legal team occur in this case.
The complaint, by PJ O’Brien & Associates, against Justice Rofe has been made not just to the Federal Court, but also to all Members and Senators of Parliament in accordance with section 72 (ii) of the Commonwealth Constitution, which allows judges to be removed from their position on the ground of proved misbehaviour or incapacity.
Irrespective of the merits of the case, as stated in the complaint, “a reasonable observer could and can conclude that by Justice Rofe not disclosing the prior and significant relationship with Pfizer, and close working relationships and familial ties (with the pharmaceutical industry), this created and creates a perception her Honour intended to conceal her prior relationship with Pfizer, and ostensibly from the applicant in the case (Dr Fidge)”.
The complaint is being supported in the Parliament by Senators Malcolm Roberts, Gerard Rennick, Ralph Babet, Alex Antic and Russell Broadbent MP.
This matter is not as much about COVID as it is about the principle of judicial integrity.
While SkyNews.com.au does not suggest that Justice Rofe’s previous relationship with Pfizer influenced her Honour’s decision making, to maintain public confidence in the courts, and in the fundamental principle of the separation of powers, judges are duty bound to disclose not only potential conflicts, but also perceived conflicts.

Australia’s judicial integrity under fire after judge in COVID vaccine case is accused of failing to disclose links to Pfizer
A judge allegedly failed to disclose her links to Pfizer in a case that would have scuttled its COVID vaccines in Australia – raising serious questions about our justice system, writes Rocco Loiacono.
The complaint, by PJ O’Brien & Associates, against Justice Rofe has been made not just to the Federal Court, but also to all Members and Senators of Parliament in accordance with section 72 (ii) of the Commonwealth Constitution, which allows judges to be removed from their position on the ground of proved misbehaviour or incapacity.
Irrespective of the merits of the case, as stated in the complaint, “a reasonable observer could and can conclude that by Justice Rofe not disclosing the prior and significant relationship with Pfizer, and close working relationships and familial ties (with the pharmaceutical industry), this created and creates a perception her Honour intended to conceal her prior relationship with Pfizer, and ostensibly from the applicant in the case (Dr Fidge)”.
The complaint is being supported in the Parliament by Senators Malcolm Roberts, Gerard Rennick, Ralph Babet, Alex Antic and Russell Broadbent MP.
This matter is not as much about COVID as it is about the principle of judicial integrity.

An application to the Federal Court in March by Dr Julian Fidge alleging Pfizer’s Covid 19 vaccines contain genetically modified organisms and therefore should be licenced under the Gene Technology Act was dismissed by Judge Helen Rofe.
Retired barrister Julian Gillespie helped prepare an appeal against the Federal Court dismissal.
Judge Rofe who determined Julian Gillespie had no standing, had a massive conflict of interest having represented vaccine giant Pfizer as a barrister on five occasions before being appointed a judge.
Rofe concealed her connection to Pfizer when she had ample opportunity to reveal this association when Julian Gillespie presented a case against the vaxxine giant.

The COVID “vaccines” aren’t vaccines after all, according to a ruling from the 9th Circuit Court of Appeals.
Dr. David Martin says that this paves the way for sweeping lawsuits because the manufacturers “willfully misled the public.”
“The manufacturers willfully misled the public by calling them [COVID shots] a vaccine.” This is a violation of the Federal Trade Commission acts in the U.S. and the Deceptive Medical Practices Act internationally, he emphasized.
But the implications go even further. According to Dr. Martin, the decision also cracks the liability shields that have protected various entities involved in mandating and administrating the mRNA injections.
“What this also does is [it] starts to give us the cracks that we need to pierce the liability shields against vaccine manufacturers and against the individuals, employers, pharmacists, doctors, nurses, hospitals that actually injected people for the first time. We actually now have the ability to say that the 9th Circuit has held that Jacobson was misapplied, that this did not stop infection, did not stop transmission, and as such, the public was willfully misled, which is a crime.”

Kansas Attorney General Kris Kobach announced Monday he is suing pharmaceutical giant Pfizer for misleading Kansas residents about the safety and efficacy of its COVID-19 vaccine.
During a press conference in Topeka, alongside Deputy Attorney General Fran Oleen and Assistant Attorneys General Kaley Schrader and Melanie Jack, Kobach detailed the allegations lodged against Pfizer.
“Pfizer made multiple misleading statements to deceive the public about its vaccine at a time when Americans needed the truth,” said Kobach.
The complaint, lodged today in Thomas County District Court, accuses Pfizer of misleading Kansans about the vaccines’ risks, including potential harm to pregnant women and the risk of myocarditis. The suit further alleges that Pfizer falsely claimed its vaccine was effective against COVID variants, despite evidence to the contrary.
Pfizer is also accused of suggesting its vaccine prevented COVID-19 transmission despite admitting it had not studied whether its vaccine halted transmission.

St. Vincent’s Hospital in Sydney released a statement saying: “Vaccination status against various infections is a critical part of this assessment in order to ensure optimal prospects of survival post-transplant.” What evidence exists to support this claim? There is not one study that suggests an organ transplant is more effective with the mRNA COVID vaccine, in fact, studies would suggest the contrary.
Her father told news outlets that the hospital called his daughter a “major threat to everyone [who was currently hospitalized] who had done the right thing” as she could spread COVID. Anyone could spread COVID. There is no evidence that the vaccine can prevent transmission or infection. Australia is still operating based on “the science” that Anthony Fauci himself has revealed to be a lie.
Federal Assistant Health Minister Ged Kearney said that the Australian government could not intervene in clinical decisions based on mandates that the government implemented. The government of South Wales said the hospital was merely following the guidelines presented by the International Society of Heart/Lung Transplantation recommendations, and the Transplant Society of Australia and New Zealand.
The rules surrounding COVID have claimed far more lives than the actual virus. Australia has become completely tyrannical in dealing with this flu variant. When will these people be held responsible for all the lives they have claimed in the name of “science?” This young girl could be alive today if the government permitted medical autonomy.

Dr Tedros, who is also the principal “global health” adviser to the United Nations, was the health minister in Ethiopia’s ruling Communist party known as the “Tigray People’s Liberation Front”. This communist organisation was listed by the US government as a terrorist organisation. It received financial support from the Chinese Government, which also supported Dr Tedros to head the WHO.
Dr Tedros has also been seen as closely aligned to Bill Gates and the Bill and Melinda Gates Foundation, which are the biggest private funders of the WHO. The WHO and Dr Tedros strongly supported mandates and vaccinations, as did Bill Gates, who is heavily invested in vaccine companies and profited from them during the pandemic.
At present the WHO’s recommendations are non-binding to member states. However, If Australia fails to reject the proposed amendments to the International Health regulations and the proposed Pandemic Treaty in April and May this year, our nation will be bound to obey every medical direction from the WHO. Our doctors, health administrators and citizens will have no choice. The WHO’s proposed changes will make its “health” recommendations mandatory. The WHO is also moving to expand its powers to decide upon whether a situation constitutes a potential emergency or public health risk and if it does, to order lock downs and other measures.
In page 16 of the the Treaty, member states will be encouraged to engage in “innovative research and development for addressing novel pathogens”, while making sure that a nation’s own standards “do not create any unnecessary administrative hurdles for research”. This indicates that the WHO supports “Gain of function” research of the kind that was being done at Wuhan and is now seen by most scientists as creating the pandemic.
The WHO wants to be in control of ALL pathogens with pandemic potential! (Pages 17-18 of the “treaty”!) They want the genomic sequences and also every single benefit which would arise from having the control of these pathogens.
The WHO also wants to increase funding to censor what they deem to be medical “misinformation and disinformation”. They seek to be the final arbiter and judge over what is medical “misinformation” and to be responsible for censoring it.
In summary, the WHO Treaty and proposed changes to the International Health Regulations form an attempt to create a medical dictatorship.
In page 21 of the Treaty the WHO is wanting to rebrand mandatory lock downs, restrictions and quarantines as “protection of human rights”!
If member states confirm this Treaty, the WHO will have the power to dictate, control and direct the supply of pharmaceutical products and the member states under law, would have to do what they are told! (Page 13).
Under this Treaty, member states will be expected to speed up the approval of pharmaceutical products and not take precautions to check whether they are safe for consumers. (Page 15)
The WHO is also seeking under the Treaty to extend its powers beyond advising on human health, to be able to declare a climate or environmental emergency and enforce consequent lock downs.

He then goes on to implore Dr. Gerberding to respond to questions that had been raised by “Representative David Weldon” regarding the integrity of CDC scientists working in the immunization program. He also explains that the CDC has been covering up the truth about the safety problems the agency’s own scientists had documented with vaccines, saying:
“I’ve repeatedly told individuals in the [National Immunization Program Office of Directors] over the last several years that they’re doing a very poor job representing immunization safety issues and that we’re losing the public relations war.”
In response to this letter, the CDC took deliberate action to retroactively alter the outcome of the autism study by arbitrarily eliminating most subjects from the study, thereby shrinking the sample size to a small data set which would not achieve statistical significance. This is a clear and irrefutable case of scientific fraud. This fraud allowed CDC scientists such as Colleen Boyle to testify before Congress that there was “no credible link” between MMR vaccines and autism.

The stakes are particularly high for the Merck lawsuit because of the huge amount of money involved and because of the politicization of the vaccine issue by government elites and their corporate masters who aim to divide the American public.
The credibility of the pharmaceutical industry — whose profits reached $1.6 trillion in 2023 — is currently at an all-time low. This is because of its role in profiteering off of, and probably creating, what many are calling a “plandemic” through unethical gain-of-function research in collaboration with intelligence agencies that resulted in the lab manufacture of the COVID-19 virus.
The story told in “Protocol 7” seems to have foreshadowed Big Pharma’s efforts in pushing ineffective and unsafe vaccines on the public during the COVID-19 pandemic while controlling dominant narratives to marginalize advocates of alternative treatments, independent journalists, and political candidates and whistleblowers.

Former Centers for Disease Control and Prevention (CDC) Director Robert Redfield confirmed the dangers of mRNA COVID-19 vaccines in a U.S. Senate hearing Thursday, calling them “toxic” and saying they should never have been mandated.
Redfield’s admissions came during a Senate Committee on Homeland Security and Governmental Affairs hearing on government oversight of taxpayer-funded high-risk virus research.
The late admission of vaccine injuries underscores the failure of public health agencies and the medical establishment to provide informed consent to the billions of vaccine recipients worldwide.
“It’s important that he is telling the truth now,” vaccine researcher Jessica Rose, Ph.D., told The Defender. “Adverse events were hidden and still are being hidden to prevent injection hesitancy.”
Redfield, who led the CDC from 2018 to 2021, didn’t stop there. He declared biosecurity “our nation’s greatest national security threat,” calling for a halt to gain-of-function research pending further debate.
The hearing, which featured contentious exchanges between senators and witnesses, also touched on controversial topics such as the COVID-19 origins lab-leak theory and allegations that health agencies suppressed data.
